Initiating a Personal Injury Case

Wonder if you have a personal injury case? You may feel that if the injury was accidental and no intent to harm existed, then there is no case against the other person or business involved in the accident. Maybe you notice you've suffered an injury months or years later. So what can you do?

Consulting with a personal injury attorney is the best way to determine whether or not your injury qualifies as a personal injury case. The attorney will determine whether or not there was negligence on the part of the other party involved in the accident. Negligence is defined as a failure to exercise reasonable care. Reasonable care is something a prudent person would maintain, and when that lack of care and maintenance results in injury, a personal injury case may be established.

The attorney will need to know all of the details of the accident, including any police report or injury report that was made, witnesses, doctors bills, emergency room reports and lost work, if any. If the accident involved property damage, such as damage to a vehicle, the attorney will need your insurance information as well as vehicle repair costs.

Other than injuries caused by traffic accidents, another of the most common types of personal injuries is a “slip and fall.” This may occur as a result of something such as a loose carpet and more commonly, water on a floor. This type of occurrence results in more delayed reactions than vehicle accidents. If you suspect that you are suffering pain or change in function from a slip and fall, you may need to act quickly if it has been some time after the accident. Statutes of limitation only allow a certain period of time within which you may initiate an action against a party to the accident.

Many people do not wish to “sue” someone for an accident that “could have happened to anybody.” Although you may not be suffering widespread pain or a decrease in functioning now, down the road, the pain could get worse and cause you daily pain and suffering or even lost work. You may not be able to engage in your favorite activities or engage in family functions as you had in the past. Whatever the case, your claim for compensation in a personal injury case is not about punishing the other party; it's about compensating you for current or future damage suffered.
