Soldier’s lives are lost everyday and we see this in the media regularly.  We hear the tragic circumstances of how soldiers died in Iraq or Afghanistan, how they died and what regiment they were a member of.  We normally see a piece about the grieving relatives that they have left behind; all of which is very tragic and upsetting especially as it is a regular occurrence.

On the other end of the spectrum, there is little or nothing written about the soldiers and service people who are injured as a result of armed forces service.  There maybe the odd article of a severely physically injured soldier in the line of duty however there is a broad area that goes un-reported.

If a soldier is injured as a result of service in the armed forces they are entitled to claim benefits in the usual way if they are disabled and or too sick to work. There is a further benefit they can claim called a War Pension. This benefit is payable if the claimant has suffered an injury physical or mental that was caused or made worse by service in the armed forces.

This may be a clear decision especially if the claimant has suffered severe physical injuries. The uncertainty arises when a claimant has suffered a mental health problem as a result of service in the armed forces.

There are thousands of service men and women sent home from army duty as they are no longer fit to continue due to suffering a mental breakdown as a result of horrific experiences witnessed at whilst serving at war.

Main illnesses include are paranoid schizophrenia, post traumatic stress disorder and depression. These conditions have various triggers - not only from the horrific experiences from service at war, they can also be related to a persons family history or upbringing. Many claims for War Pension Benefits are being refused as it is argued that some mental health conditions are not caused or made worse by service in the armed forces. Detailed psychiatric evidence is required to detail the triggers elements that can cause the mental disablement.

As the war continues more and more are being affected mentally by their experiences, with some unable to overcome these.  This prevents them from returning to their previous way of life.  If entitlement to the War Pension is refused, there is an appeal process.  The Armed Forces Tribunal Chamber hears appeals from ex-service and army soldiers.
